The US Supreme Court's Decision: A Mixed Bag for New Zealand's Exporters

The US Supreme Court's ruling on President Donald Trump's 'Liberation Day' tariffs has sparked a wave of cautious optimism in New Zealand, but also a sense of considerable uncertainty. The court's majority decision declared it unconstitutional for the president to unilaterally set and change tariffs, as the power to tax is reserved for Congress. This ruling effectively struck down much of Trump's sweeping tariff infrastructure, labeling it an illegal use of emergency powers.

President Trump, speaking from the White House, expressed his disappointment and frustration with the decision, calling it incorrect and deeply disappointing. He vowed to impose a global 10% tariff as an alternative, while continuing to push his trade policies through other means. The new tariffs would be in place for 150 days under a specific law.

Trade Minister Todd McClay acknowledged the potential significance of the Supreme Court's decision for New Zealand exporters. However, he also warned that considerable uncertainty may persist. McClay noted that New Zealand's exports to the US had withstood the 15% Liberation Day tariff, with evidence suggesting that cost increases were being passed on in many cases. He emphasized that any reduction in tariffs is positive news.

Despite the positive impact of the tariff reduction, New Zealand remains critical of the 15% tariff imposed on its exporters. The country argues that the average tariff rate applied to US goods entering New Zealand is only 0.3%, making the 15% tariff unjustified. New Zealand's Embassy in Washington will work closely with its US counterparts to gather more information, enabling them to continue supporting exporters. However, McClay cautioned that uncertainty surrounding US tariff policy is likely to persist for an extended period.
